What Is Mediation?

Mediation is a structured process in which an independent mediator helps the parties communicate, identify the issues in dispute and work towards an agreement.

The mediator does not decide the outcome. Instead, the parties are given an opportunity to be heard, discuss their concerns and find solutions that work for their particular circumstances.

When Can Mediation Help?

Mediation can be useful in a range of family-law matters, including:

  • Divorce and settlement agreements

  • Parenting plans

  • Care and contact arrangements

  • Child maintenance

  • Separation arrangements

  • Financial disputes

  • Other family disagreements

Where successful, mediation can reduce conflict, give both parties greater control over the outcome, and potentially save time and legal costs. It can also encourage better communication, which can be particularly important where parents need to continue co-parenting after their dispute has been resolved.

Is Mediation Right for Everyone?

No. Mediation is not appropriate in every situation.

Where there is domestic violence, intimidation, a significant imbalance of power or other circumstances that make meaningful negotiation difficult or unsafe, a different approach may be necessary.

Mediation also does not guarantee that an agreement will be reached. If the matter cannot be resolved through negotiation or mediation, we can advise you on the next legal steps and, where necessary, assist with formal legal proceedings.
